By accessing this website or purchasing products from Monitors.com, you agree to these Terms.
Section 2
Product Condition and Source
Unless expressly stated otherwise on the applicable product page, quote, or invoice, products sold by Monitors.com may be new, new pull, open box, pre-owned, certified pre-owned, renewed, or refurbished.
- Refurbished, renewed, serviced, tested, or certified products are processed exclusively by Bayland Technologies, Inc.
- Monitors.com is an independent seller and service provider.
- Monitors.com is not an authorized distributor, authorized service center, authorized refurbisher, or authorized warranty provider for any manufacturer or brand listed on the website.
- Products described as "new" may be sourced through primary or secondary distribution channels and may not originate directly from the original manufacturer.
- Packaging, including accessories, inserts, and manufacturer registration eligibility, may vary from original manufacturer packaging or standards.
Section 3
Product Condition Definitions
New items not previously used. These may be sourced from authorized or secondary channels and may not be supplied directly from the original manufacturer.
New PullItems removed from new systems or packaging for resale. Typically unused, but minor handling or installation marks may be present.
Open BoxItems whose packaging has been opened for inspection, display, return, or related purposes. These items may show light handling wear.
Pre-Owned Items that have been previously used and functionally tested by Monitors.com.
Certified Pre-Owned: Pre-owned items that have been tested, inspected, and certified by Monitors.com according to internal quality standards.
Renewed / Refurbished Items restored, repaired, reconditioned, or serviced by Bayland Technologies, Inc., unless otherwise expressly stated.
Section 4
Pricing, Orders, and Payment
All prices are listed in U.S. Dollars unless otherwise stated.
Monitors.com reserves the right to correct typographical, pricing, listing, inventory, descriptive, or availability errors at any time. If a product is listed at an incorrect price or with incorrect information due to an error, Monitors.com reserves the right to refuse, cancel, or limit any order placed for that product, whether or not the order has been confirmed and whether or not payment has already been processed.
If payment has already been captured for a canceled order, a refund will be issued for the amount paid, less any non-refundable payment processing charges where permitted by law.
Monitors.com retains title to products sold until payment is made in full.
Section 5
Shipping, Delivery, and Risk of Loss
Shipping rates, delivery estimates, and transit times are estimates only and are not guaranteed unless expressly stated otherwise in writing.
Monitors.com is not responsible for carrier delays, customs delays, weather interruptions, delivery exceptions, or other circumstances beyond Monitors.com's reasonable control.
Unless otherwise required by applicable law, risk of loss and risk of damage pass to the buyer when the shipment is delivered to the carrier for transport to the buyer.
If the buyer elects to use the buyer's own shipping account or third-party shipper, the buyer is responsible for any related taxes, claims, damage claims, insurance claims, and carrier disputes.
Section 6
Inspection Upon Delivery; Shipping Damage Claims
The buyer or recipient must inspect the shipment promptly upon delivery.
Any claim for manifest shipping damage must be reported in writing to Monitors.com within three (3) calendar days of delivery.
To support any shipping damage claim, the buyer must:
- retain the original packaging,
- provide photographs and, if requested, video evidence of the damage,
- provide photographs of the packaging and shipping label, and
- Cooperate with any carrier claim requirements.
If Notice is not provided within this three (3) calendar day period, Monitors.com will have no obligation to assist in or initiate a carrier damage claim, or to provide return, replacement, or refund rights based on shipping damage.
Section 7
DOA and Not-as-Described Claims
If a product is alleged to be dead on arrival ("DOA") or materially not as described, the buyer must notify Monitors.com in writing within three (3) business days of delivery.
Claims reported after this three (3) business day period will not be treated as DOA or not-as-described claims. Instead, if applicable, they will be handled under the product's warranty coverage.
For any DOA or not-as-described claim, Monitors.com may require troubleshooting, photographs, video evidence, serial numbers, packaging evidence, return inspection, or other reasonable verification before approving any remedy.
If a DOA or not-as-described claim is approved, Monitors.com may, in its sole discretion and subject to applicable law, provide one of the following remedies:
- repair,
- replacement,
- store credit, or
- refund.
Section 8
Warranty Terms
Unless a different warranty term is expressly stated on the applicable product page, quote, or invoice, products sold by Monitors.com are covered only by the warranty expressly provided by Monitors.com.
- Manufacturer warranties may not apply.
- Any manufacturer warranty, if available, is separate from and not guaranteed by Monitors.com.
- Warranty claims must be made through Monitors.com unless Monitors.com expressly instructs otherwise.
Unless a different term is stated in writing, items sold without a separate stated warranty are covered by a 90-day limited warranty from the date of delivery.
This limited warranty does not cover:
- damage caused by misuse, abuse, neglect, accident, improper installation, unauthorized repair, or improper storage;
- cosmetic wear not affecting functionality;
- Shipping damage was not timely reported.
- software or licensing issues unless expressly covered;
- consumables, calibration drift, or normal wear and tear; or
- any issue arising after modification or use outside intended operating conditions.
For approved warranty service, the buyer is responsible for shipping the product to the designated service location, prepaid and properly insured, unless otherwise stated in writing. Unless otherwise stated in writing, all shipping charges associated with warranty replacement or warranty service are the responsibility of the buyer.
Monitors.com disclaims all warranties not expressly stated herein to the maximum extent permitted by law, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement.
Section 9
Hot-Swap and Loaner Coverage
Monitors.com offers advanced hot-swap and loaner service only for products specifically quoted, designated, or marked as eligible for hot-swap coverage. Hot-swap and loaner services are subject to availability.
- Any replacement or loaner unit provided under hot-swap coverage may be identical or comparable.
- Replacement or loaner units may come from the same or a different manufacturer.
- Replacement or loaner units may be new, renewed, refurbished, pre-owned, or open-box.
If an identical unit is unavailable, Monitors.com may provide a reasonably comparable substitute unit, subject to availability.
Unless otherwise agreed in writing, all shipping charges for hot-swap or loaner service are the buyer's responsibility.
Hot-swap coverage does not guarantee uninterrupted service, identical cosmetic condition, or identical manufacturer packaging.
Section 10
Order Cancellations
Orders may be canceled within 24 hours of placement, provided the order has not already shipped, been specially processed, or been designated as non-cancelable.
If a cancellation request is approved within 24 hours, no restocking fee will apply; however, the refund may be reduced by any non-refundable payment processing fee, including a 3.99% credit card processing fee, if such fee is not returned to Monitors.com by the payment processor, and where permitted by law.
Cancellation requests submitted more than 24 hours after the order is placed are subject to the applicable return policy, even if the order has not yet been delivered.
Special-order items, specifically discounted quoted items, and large-volume orders may be non-cancelable as stated in the quotation, invoice, product listing, or other written sales documentation.
Section 11
Return Policy
11.1 Standard Return Eligibility
Except as otherwise stated on the product page, quotation, invoice, or in these Terms, eligible products may be returned only if the product page or sales documentation expressly states that a 14-Day Return Guarantee or a 30-Day Return Guarantee covers the item.
If a product is specifically identified as covered by a 14-Day Return Guarantee, it may be returned within 14 days of the order date.
If a product is specifically identified as covered by a 30-Day Return Guarantee, it may be returned within 30 days of the order date.
No right of return exists unless a return policy or return guarantee is expressly stated for that item, or unless required by applicable law.
11.2 Non-Returnable Discounted Quoted Items
The buyer agrees that any item specifically quoted at a discounted price, special price, contract price, or other reduced-price arrangement is non-returnable and non-refundable unless otherwise expressly stated in writing by Monitors.com.
Such items remain covered under Monitors.com's standard warranty terms, unless a different warranty term is expressly stated in writing on the quotation, invoice, or product page.
11.3 Return Conditions
- The item must be returned within the applicable return window, measured from the date the order was placed.
- The buyer must obtain a valid RMA number issued by Monitors.com.
- The item must be shipped prepaid and fully insured by the buyer.
- all accessories, manuals, inserts, packaging, and components originally included must be returned where applicable;
- The item must be in substantially the same condition as received, and
- the item must not be altered, damaged, misused, or missing identifying labels or serial numbers.
Returns sent without an RMA number or sent freight collect may be refused.
11.4 Restocking and Processing Fees
Renewed, Open Box, Certified Refurbished, Demo, Refurbished, Pre-Owned, and Certified Pre-Owned 10% restocking fee plus any non-refundable 3.99% payment processing fee.
New Products 20% restocking fee plus any non-refundable 3.99% payment processing fee.
The buyer is responsible for all return shipping costs unless Monitors.com agrees otherwise in writing or applicable law requires otherwise.
11.5 Non-Returnable Items
- licensed software or software keys,
- calibration sensors,
- calibration tools,
- special-order items,
- specifically discounted quoted items,
- products specifically marked non-returnable,
- products missing serial numbers, or
- products altered after delivery.
Section 12
Exchanges
Exchanges are permitted only with prior written approval from Monitors.com and issuance of an RMA number. Approved exchanges must comply with the same deadlines, packaging, shipping, and condition requirements as returns.
Section 13
Domestic and International Orders; Taxes, Duties, Customs, and Brokerage Fees
Monitors.com will not refund taxes based on a buyer's post-order claim of tax-exempt, reseller, nonprofit, or government status where taxes were calculated and paid at the time of purchase. Any buyer seeking tax-exempt treatment must have its account approved and designated as tax-exempt by Monitors.com before placing the order. If taxes are paid on an order, any refund request based on exemption status must be made directly by the buyer to the applicable state taxing authority. No exceptions will be made. For international orders, the buyer is solely responsible for all taxes, VAT, GST, duties, customs clearance fees, import fees, brokerage charges, and similar governmental or carrier-imposed charges unless expressly stated otherwise at checkout.
These charges are non-refundable by Monitors.com. If such amounts are advanced, collected, or remitted in connection with the shipment, they will not be refunded by Monitors.com in the event of cancellation, return, refusal of delivery, failure of customs clearance, or any other circumstance.
The buyer may contact the relevant customs, tax, or governmental authority directly regarding any refund rights that may exist under local law. Any such refund must be pursued directly by the buyer. Monitors.com does not process such refunds and may deduct or exclude such amounts from any refund issued.
Section 14
Limitation of Remedies
To the maximum extent permitted by law, Monitors.com's obligations with respect to any approved claim, including warranty, return, DOA, or not-as-described claims, are limited to the remedies expressly stated in these Terms.
Except where prohibited by law, Monitors.com may choose, in its discretion, to repair, replace, issue store credit, or refund the purchase price actually paid for the applicable product, less any applicable fees, shipping charges, taxes, duties, customs charges, brokerage charges, or other non-refundable amounts.
Section 15
Disclaimer of Liability
To the maximum extent permitted by law, all products, services, website content, and related materials are provided "as is" and "as available," except for any express limited warranty specifically stated in these Terms or on the product page.
Monitors.com makes no representation that the website will be uninterrupted, error-free, or secure.
Monitors.com shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, loss of data, or loss of opportunity, arising from any order, product, service, or use of the website.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.

All content on this website, including text, graphics, photos, layouts, software, and compilations, is the property of Bayland Technologies, Inc. or its licensors and is protected by applicable intellectual property laws.
All third-party product names, model numbers, logos, and trademarks remain the property of their respective owners and are used solely for identification, compatibility, comparison, or descriptive purposes. Their use does not imply sponsorship, authorization, affiliation, or endorsement unless expressly stated.

Unless expressly stated on a specific product page, Monitors.com and Bayland Technologies, Inc. are not affiliated with, endorsed by, sponsored by, or authorized by any brand, manufacturer, or trademark owner mentioned on this website.
References to brands, part numbers, model numbers, and trademarks are provided only for identification and descriptive purposes.

User Conduct
By using this website, you agree not to:
- interfere with the website or its servers,
- attempt unauthorized access to any system or data,
- submit fraudulent or unauthorized orders,

- violate any applicable law, rule, or regulation.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

Governing Law and Venue
These Terms, and any dispute arising out of or related to the website, any order, or any transaction with Monitors.com, shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
The parties agree that any claim or dispute arising out of or relating to these Terms, the website, or any purchase from Monitors.com shall be brought exclusively in the state or federal courts located in Houston, Harris County, Texas, and each party consents to the personal jurisdiction and venue of those courts.
Section 20
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be enforced to the maximum extent permitted by law.
Section 21
Changes to These Terms
Monitors.com reserves the right to modify these Terms at any time. Updated Terms become effective upon posting to the website unless otherwise stated. Continued use of the website or placement of an order after the updated Terms are posted constitutes acceptance of the revised Terms.
